West Texas A&M University's ban on drag shows on campus will stand after the U.S. Supreme Court declined to take up a student challenge to the prohibition.

The big picture: The high court denied the request from LGBTQ student group Spectrum WT, which had argued the ban violates the First Amendment following objections from university administrators.


Where it stands: The U.S. Fifth Circuit Court of Appeals will hear arguments in the case the week of April 29.

  • The unsigned order, which listed no dissenting votes and did not offer an explanation, likely means a drag show planned for March 22 cannot take place on campus.
  • The university denied to comment on the pending litigation.
  • JT Morris, an attorney with the Foundation for Individual Rights and Expression who represents Spectrum WT, said in a statement to Axios that while today's denial is disappointing "we'll keep fighting for our clients' First Amendment rights."  "The show is not over," he added.
