The U.S. Supreme Court struck down the Biden administration’s eviction moratorium on Thursday evening, imperiling the housing security of millions of Americans. Siding with a group of landlords that challenged the ban, the court ruled that the Centers for Disease Control and Prevention exceeded its authority by issuing the order earlier this month. The decision doesn’t come as a great surprise: In a June ruling allowing the CDC to extend an earlier moratorium, Justice Brett Kavanaugh wrote that any further action must come from Congress. Progressives and the White House have pushed Congress to pass legislation, but despite efforts from Democratic lawmakers, there weren’t enough votes. President Joe Biden in late July also called on state and local leaders to "urgently accelerate" the distribution of $46.5 billion in federal emergency rental assistance, which has been slow to roll out. Only $5 billion had reached households in need by the end of last month, and some landlords have even continued to file evictions in hopes of speeding up the delivery.
